Terms of Service

These Terms of Service (hereinafter referred to as "Terms") set forth the terms and conditions for the use of the online shop (hereinafter referred to as "Service") provided by Fafuri Co., Ltd. (hereinafter referred to as "Company") on this website. Registered users (hereinafter referred to as "Users") are required to use the Service in accordance with these Terms.

Article 1 (Application)
1. These Terms shall apply to all relationships between Users and the Company regarding the use of the Service.
2. The Company may establish rules and other provisions (hereinafter referred to as "Individual Provisions") for the use of the Service in addition to these Terms. These Individual Provisions shall constitute part of these Terms regardless of their names.
3. If the provisions of these Terms conflict with the Individual Provisions, the Individual Provisions shall prevail unless otherwise specified in the Individual Provisions.

Article 2 (User Registration)
1. For this Service, user registration is completed when the applicant agrees to these Terms, applies for registration in the manner specified by the Company, and the Company notifies the applicant of its approval.
2. The Company may not approve a registration application if it determines that the applicant falls under any of the following circumstances, and shall not be obligated to disclose any reasons:
(1) When false information is submitted in the registration application
(2) When the application is from a person who has violated these Terms in the past
(3) In other cases where the Company deems the registration inappropriate

Article 3 (Management of User ID and Password)
1. Users shall manage their User ID and password for this Service at their own responsibility.
2. Under no circumstances may Users transfer, lend, or share their User ID and password with third parties. The Company shall consider any access using the combination of a User ID and password matching the registered information as use by the User who registered that User ID.
3. The Company shall not be liable for any damages caused by the use of a User ID and password by a third party, except in cases of intentional or gross negligence on the part of the Company.

Article 4 (Sales Contract)
1. In this Service, a sales contract is established when a User submits a purchase application to the Company, and the Company notifies the acceptance of said application. The ownership of the product shall be transferred to the User when the Company hands over the product to the shipping company.
2. The Company may cancel the sales contract mentioned in the previous paragraph without prior notice to the User if the User falls under any of the following circumstances:
(1) When the User violates these Terms
(2) When product delivery cannot be completed due to an unknown delivery address or prolonged absence
(3) In other cases where the Company determines that the trust relationship with the User has been damaged
3. Payment methods, shipping methods, order cancellation methods, or return methods related to this Service shall be as separately specified by the Company.

Article 5 (Intellectual Property Rights)
The copyrights or other intellectual property rights of product photos and other content provided through this Service (hereinafter referred to as "Content") belong to the Company and legitimate rights holders such as content providers. Users may not reproduce, reprint, modify, or make any other secondary use of these without permission.

Article 6 (Prohibited Actions)
Users shall not engage in the following actions when using this Service:
1. Actions that violate laws or public order and morals
2. Actions related to criminal activities
3. Actions that infringe on copyrights, trademarks, or other intellectual property rights included in this Service
4. Actions that destroy or interfere with the functions of the Company's server or network
5. Actions that commercially use information obtained through this Service
6. Actions that may interfere with the operation of the Company's services
7. Unauthorized access or attempts to gain unauthorized access
8. Actions to collect or accumulate personal information of other users
9. Actions to impersonate other users
10. Actions that directly or indirectly provide benefits to anti-social forces in relation to the Company's services
11. Any other actions that the Company deems inappropriate

Article 7 (Suspension of Service Provision)
1. The Company may suspend or interrupt the provision of all or part of the Service without prior notice to Users if it determines that any of the following circumstances apply:
(1) When performing maintenance or updates on the computer system related to this Service
(2) When it becomes difficult to provide the Service due to force majeure such as earthquakes, lightning, fire, power outages, or natural disasters
(3) When computers or communication lines are stopped due to accidents
(4) In other cases where the Company determines that it is difficult to provide the Service
2. The Company shall not be liable for any disadvantages or damages suffered by Users or third parties due to the suspension or interruption of the Service provision, regardless of the reason.

Article 8 (Usage Restrictions and Cancellation of Registration)
1. The Company may restrict the use of all or part of the Service or cancel the User's registration without prior notice if any of the following apply:
(1) When any provision of these Terms is violated
(2) When it is discovered that there are false facts in the registered information
(3) When the credit card registered by the User as a payment method is suspended
(4) When there is a failure to fulfill payment obligations for fees, etc.
(5) When there is no response to communication from the Company for a certain period
(6) When there has been no use of the Service for a certain period after the last use
(7) In other cases where the Company deems the use of the Service inappropriate
2. The Company shall not be liable for any damages incurred by Users due to actions taken by the Company based on this article.

Article 9 (Withdrawal)
Users may withdraw from this Service through the prescribed withdrawal procedure.

Article 10 (Disclaimer and Exemption)
1. The Company does not guarantee that there are no defects in fact or law in this Service (including defects related to safety, reliability, accuracy, completeness, validity, fitness for a particular purpose, security, errors, bugs, rights infringement, etc.).
2. The Company shall not be liable for any damages incurred by Users through this Service. However, if the contract between the Company and Users regarding this Service (including these Terms) falls under a consumer contract as defined by the Consumer Contract Act, this exemption clause shall not apply. Even in such cases, the Company shall not be liable for any damages arising from special circumstances (including cases where the Company or Users foresaw or could have foreseen the occurrence of damages) among damages incurred by Users due to the Company's breach of obligations or tort caused by negligence (excluding gross negligence).
3. The Company shall not be liable for any transactions, communications, or disputes that occur between Users and other Users or third parties regarding this Service.

Article 11 (Changes to Service Content)
The Company may change the content of this Service or discontinue the provision of this Service without notifying Users, and shall not be liable for any damages incurred by Users as a result.

Article 12 (Changes to Terms of Service)
The Company may change these Terms at any time without notifying Users when deemed necessary. If a User starts using the Service after changes to these Terms, that User shall be deemed to have agreed to the changed Terms.

Article 13 (Handling of Personal Information)
The Company shall appropriately handle personal information obtained through the use of this Service in accordance with the Company's "Privacy Policy."

Article 14 (Notification or Communication)
Notifications or communications between Users and the Company shall be made in the manner specified by the Company. The Company shall consider the currently registered contact information as valid and send notifications or communications to that contact information unless there is a change notification from the User following the method separately specified by the Company. These shall be deemed to have reached the User at the time of transmission.

Article 15 (Prohibition of Transfer of Rights and Obligations)
Users may not transfer their position under the usage contract or rights or obligations based on these Terms to third parties, or provide them as collateral, without the prior written consent of the Company.

Article 16 (Governing Law and Jurisdiction)
1. The interpretation of these Terms shall be governed by Japanese law. The United Nations Convention on Contracts for the International Sale of Goods shall not apply to this Service.
2. In the event of a dispute regarding this Service, the court having jurisdiction over the location of the Company's head office shall be the exclusive agreed jurisdiction court.
